Platform B: Amplifying Strong and Credible SEE Voices

Together with our partners, BIRN is launching a series of online and offline events aimed to amplify the voices of strong and credible individuals and organisations in the region that promote the core values of democracy, such as civic engagement, independent institutions, transparency and rule of law.

As a primarily media organisation, we want to open space and provide a platform to discuss and reshape our alliances in light of the challenges facing democracies in South-East and Central Europe.

This effort comes at a critical time when the region is seeing several troubling trends: centralized power, reduced transparency, assaults on media, politicized judiciaries, unchecked corruption, online violations and social polarization – all amidst heightened geopolitical tensions and deep divisions in Europe.

Due to the ongoing pandemic, Platform B event series will be organised in accordance with all relevant health measures. As the situation improves, we hope to be able to host some of the events in BIRN spaces in Sarajevo and Belgrade, and elsewhere in the region.

The Platform B will be an opportunity for individuals and groups to meet monthly on selected topics.

Opening event: Digital Rights Falter Amid Political and Social Unrest: What Now?

At this event, BIRN and SHARE Foundation will discuss its annual digital rights report,together with other members of the newly established SEE Network, talking about the key trends concerning the digital ecosystem.

We monitored digital rights in Bosnia and Herzegovina, Croatia, Hungary, North Macedonia, Romania and Serbia and collected more than 1500 cases of online violations.

In Southern and Eastern Europe, where online disinformation campaigns are endangering guaranteed individual freedoms, and while the decline in internet safety has become a worrying trend, citizens with poor media and digital illiteracy have been left without viable protection mechanisms.

The event participants will have an opportunity to discuss and hear reflections from representatives of: EDRi, Zasto ne?, Citizen D, Homo Digitalis, SCiDEV, Partners Serbia, Metamorphosis, Atina NGO, Media Development Center.

Second event: Freedom of Information in the Balkans: Classified, Rejected, Delayed

The global pandemic has been used as an excuse for many Balkan states to not fully implement freedom of information laws, leaving the public in the dark.

Transparency has been another victim of the COVID-19 pandemic.

While on paper, freedom of information laws are up-to-date in almost all countries in the region, implementation is patchy at best and has grown worse since governments clamped down on the flow of information with the onset of the coronavirus.

Together with journalists, public information officers and colleagues from Open Government Partnership we will reflect on the findings of BIRN’s tracking institutional transparency report and offer recommendations on how to make our institutions open and accountable.

Kosovo Media Criticise Call for State Regulation of Online Content

The Press Council of Kosovo, PCK, and the Association of Journalists of Kosovo, AJK, on Wednesday voiced concern over the proposed regulation of online media content under the Law on the Independent Media Commission, IMC, deeming it a violation of “international rules of journalism”.

The IMC is an independent state body that regulates, manages, and oversees TV broadcasting in Kosovo but now it has said it wants video production on local websites added to its jurisdiction. Print media are already monitored by the PCK.

The PCK is a self-regulatory body formed by the print media in Kosovo, which is recognized by the Assembly of Kosovo through the Law on Defamation and Insult. Rulings that the PCK issues for parties and the media are “respected and valued by local courts in cases where they decide for defamation and insult”.

“Each of the media should be held accountable for their actions before state bodies, based on relevant laws, but initially no one can better assess their ethics than the media themselves, or professionals of the field,” the PCK and AJK said in a joint press release.

The reaction comes after the IMC head, Xhevat Latifi, said a new law on the IMC should include audio-visual content of websites within its auspices.

Latifi said this at a presentation of the IMC’s Annual Report for 2020 to parliament’s Committee on Local Government, Regional Development and Media on Tuesday. “We are witnessing a toxic state of media vocabulary in Kosovo,” Latifi said, justifying the initiative.

Later he told BIRN that the initiative was not his own and explained it as “concern of society”.

“I have stated that portals which deal with audio-visual production would best be included in the new law; not all portals, only these which deal with audio-visual parts. It is only a request. We are only measuring the public, their concerns. I have presented it as a concern of society, we cannot say this is my opinion or IMC position,” he said.

The Press Council and journalists’ associations deem the idea dangerous.

“Initiatives to control and evaluate ethics for print and online media by a state organisation are harmful and do not help the media and journalists,” their press release said.

Seizure Order Against Albanian News Portal Condemned

Human rights and media freedom groups have sharply criticised a decision by a judge, Iliriana Olldashi, at Albania’s Special Court Against Corruption and Organised Crime, SPAK, to approve a prosecutorial request made last Sunday to seize any computer, mobile phone or other electronic equipment belonging to the online publication Lapsi.al.

Experts and rights organisations called it a blatant attempt to intimidate journalists in breach of their human rights and the principles of the European Court of Human Rights, ECHR.

Prosecutors launched an investigation after Lapsi.al revealed the existence of a massive database purportedly belonging to the ruling Socialist Party containing information on each voter, including background, voting history, family links or employment status.

Prosecutors ordered Lapsi.al to hand over the database but the editors refused, saying that could expose their source or sources.

“The intervention of the prosecutors and the court against Lapsi.al’s right to report on a matter of public interest is just another attempt by those in power to intimidate the media,” Flutura Kusari, a legal advisor at the European Centre for Press and Media Freedom, ECPMF, told BIRN.

“Instead of investigating the breach of privacy by the Socialist Party, they are attempting to intimidate journalists and their sources,” Kusari added, saying that the decision contravenes the standards of the ECHR.

Dorjan Matlija, a human rights lawyer in Tirana, told BIRN that the court decision was based on flawed reasoning.

“The prosecutors have other possibilities to investigate the matter based on the accusations of the opposition Democratic Party against Prime Minister [Edi Rama] and other officials,” Matlija said.

He added that before approving such a request, the court should have considered the need to protect the sources, an obligation deriving from several decisions of the ECHR.

In the latest such decision, published this month, Sedletska vs Ukraine, the ECHR ruled that an order to expose a source may only be issued after all other ways to investigate a matter have been exhausted.

Matlija added that the judge’s unexpected order creates ground for further violations of media freedom and could expose more than one source of information. “The order practically could end up shutting down the media outlet [Lapsi] by seizing all its equipment,” he added.

Andi Bushati, co-owner of Lapsi, told BIRN that prosecutors had not yet acted on the court order, and that in the meantime he had appealed the decision.

He said the prosecutors seem more eager to identify their source than interview Socialist Party officials over the database. “They seem more concerned in finding out who betrayed the party and not who stole the personal data,” he said.

Kusari, from ECPMF, told BIRN that they were informing Albania’s international partners about this and related issues. “We hope that international pressure will help halt the pressure against the media,” she said.

Turkey Detains 39 for ‘Terrorist Propaganda’ Social Media Posts

The Turkish Interior Ministry announced on Tuesday that security forces detained 39 social media users in the first week of February for allegedly posting propaganda for terrorist organisations online.

It said that a total of 575 offenders have been detected and that detentions continue.

“Debates and developments on social media platforms as well as the social media accounts of illegal groups and structures are being followed closely,” the ministry said in a written statement.

The detainees are accused of propaganda for organisations which Turkey accepted as terrorist organisations, including the outlawed Kurdistan Workers’ Party, PKK, the so-called Islamic State, extremist leftist groups and the so-called Fethullahist Terrorist Organisation – a name Turkey uses to brand followers of exiled Turkish preacher Fethullah Gulen, who Ankara accuses of orchestrating a failed coup attempt in 2016.

The 39 detainees include several students who allegedly run social media accounts to organise the recent series of high-profile protests against the political appointment of a new rector at the prestigious Bogazici University in Istanbul.

Riot police staged a major operation to disperse the student protesters last week, with hundreds detained and dozens charged.

Aysen Sahin, an independent Turkish journalist, was also detained by police at her home on Monday evening for posting a message on Twitter during last week’s student protests.

Sahin was detained after some pro-government newspapers criticised her. She was released on Tuesday morning.

The Turkish government’s crackdown on social media users intensified after it introduced a new law on digital media last year.

The new law allows security forces to detain anyone responsible for suspicious posts which are linked to terrorist organisations or any kind of disinformation.

As part of the new law, social media platforms are forced to appoint legal representatives in the country to answer the government’s demands to delete social media posts and close accounts.

YouTube, Facebook, Instagram, TikTok and Russia’s VK social media platform decided to appoint representatives after Turkish government fined them twice. Twitter, however, is still resisting the Turkish government’s new regulations.

According to the Turkish Interior Ministry, 14,186 social media accounts were investigated and 6,743 people were tried because of their posts on social media in first eight months of 2020.

The programme aims to cover under-reported topics related to the health of the digital ecosystem and digital rights violations in Central and Southeastern Europe.

COVID’s Toll on Digital Rights in Central and Southeastern Europe

The report presents an overview of the main violations of digital rights in Bosnia and Herzegovina, Croatia, Hungary, Kosovo, Montenegro, North Macedonia, Romania and Serbia between January 31 and September 30, 2020, and makes a series of recommendations for authorities in order to curb such infringements during future social crises.

A first report, compiled by BIRN and which contained preliminary findings, showed a rise in digital rights violations in Central and Southeastern Europe during the pandemic, with over half of cases involving propaganda, disinformation or the publication of unverified information.

The global public health crisis triggered by the coronavirus exposed a new the failure of states around the world to provide a framework that would better balance the interests of safety and privacy. Instead, the report documents incidents of censorship, fake news, security breaches and concentration of information.

More than 200 pandemic-related violations tracked

At the onset of the pandemic, numerous violations of digital rights were observed – from violations of the privacy of persons in isolation to manipulation, dissemination of false information and Internet fraud.

BIRN and Share Foundation documented 221 violations in the context of COVID-19 during the eight-month monitoring period, the largest number coming during the initial peak of the pandemic in March and April – 67 and 79 respectively – before slowly declining.

The countries with the highest number of violations to date are Serbia, with 46, and Croatia, with 44.

The most common violation – accounting for roughly half of all cases – was manipulation in the digital environment caused by news sites that published unverified and inaccurate information, and by the circulating of incomplete and false data on social media.

This can be explained in large measure by the low level of media literacy in the countries of the region, where few people actually check the news and information provided to them, while the media themselves often publish unverified information.

The most common targets of digital rights violations were citizens and journalists. However, both of these groups were frequently also among the perpetrators.

Contact tracing apps: Useful or not?

The debate about the use of contact-tracing apps as a method of combating the spread of COVID-19 was one of the most important discussions in Croatia and North Macedonia.

At the very beginning of the pandemic, the Croatian government led by the conservative Croatian Democratic Union, HDZ, proposed a change to the Electronic Communications Act under which, in extraordinary situations, the health minister would request from telecommunications companies the location data of users.

Similarly, Macedonian health authorities announced they were looking to use “all tools and means” to combat the virus, with North Macedonia among the first countries in the Western Balkans to launch a contact-tracing app on April 13.

Developed and donated to the Macedonian authorities by Skopje-based software company Nextsense, the StopKorona! app is based on Bluetooth distance measuring technology and stores data locally on users’ devices, while exchanging encrypted, anonymised data relevant to the infection spread for a limited period of 14 days. According to data privacy experts, the decentralised design guaranteed that data would be stored only on devices that run the app, unless they voluntarily submit that data to health authorities.

Croatia launched its own at the end of July, but by late August media reports said the Stop COVID-19 app had been downloaded by less than two per cent of mobile phone users in the country. The threshold for it to be effective is 60 per cent, the reports said.

Key worrying trends mapped

Bosnia and Herzegovina saw a number of problems with personal data protection, free access to information and disinformation. In terms of disinformation, people were exposed to a variety of false and sometimes outlandish claims, including conspiracy theories about the origin of the coronavirus, its spread by plane and various miracle cures.

Conspiracy theories, like those blaming the spread of the virus on 5G mobile networks, flourished online in Croatia too. One person in Croatia destroyed their Wifi equipment, believing it was 5G.

In Hungary, fake news about COVID-19 arrived even before the virus itself, said journalist Akos Keller Alant, who monitored the digital environment in Hungary.

Several clickbait fake news sites published articles about COVID-19 victims a month before Hungary’s first confirmed case. The Anti-Cybercrime Unit of the Hungarian police arrested several people for spreading fake news, starting in early February when police raided the operators of a network of fake news sites.

In Kosovo, online media emerged as the biggest violators of digital rights by publishing unverified and false information as well as personal health information. Personal data rights were also violated by state institutions and public figures.

In Montenegro, the most worrying digital rights violations concerned privacy and personal data protection of those infected with the coronavirus or those forced to self-isolate.

The early days of the pandemic, when Montenegro was among the few countries that could claim to have kept a lid on the virus, was a rare moment of social and political consensus in the country about how to respond, said Tamara Milas of the Centre for Civic Education in Montenegro, an NGO.

The situation changed, however, when the government was accused of the gross violation of the right to privacy and the right to the protection of personal data.

Like its Western Balkan peers, North Macedonia was flooded with unverified information and claims shared online with regards the pandemic. Some of the most concerning cases included false claims about infected persons, causing a stir on social media.

In Romania, the government used state-of-emergency powers to shut down websites – including news and opinion sites – accused of spreading what authorities deemed fake news about the pandemic, according to BIRN correspondent Marcel Gascon, who monitors digital rights violations in Romania.

In Serbia, a prominent case concerned a breach of security in the country’s central COVID-19 database. For eight days, the login credentials for the database, Information System COVID-19, were publicly available on the website of a public health body.

In another incident, the initials, age, place-of-work and personal address of a person infected with the virus were posted on the official webpage of the municipality of Sid in western Serbia as well as on the town’s social media accounts.

In the report, BIRN and Share Foundation conclude that technology, especially in a time of crisis, should not be seen as the solution to complex issues, be that protection of health or upholding public order and safety. Rather, technology should be used to the benefit of citizens and in the interest of their rights and freedoms.

When intrusive technologies and regulations are put in place, it is hard to take a step back, particularly in societies with weak democratic institutions, the report states. Under such circumstances, the measures applied in one crisis for the protection of public health may one day be repurposed and used against other “social plagues”, ultimately leading to reduced human rights standards.

Internet Governance Key to Media Freedom in Albania

The rapid spread of the internet and growing use of social media in Albania has significantly affected the behaviour of existing or traditional media as well as native digital media. The emergence of online media outlets has dramatically changed the media landscape.

BIRN Albania’s latest report, “Internet Governance in Albania and Its Role In Media Freedom”, explores a number of topics where Internet governance and regulation intersect with online media, market conditions, financial regulations, access to information and data protection, and copyright and cyber-security.

The report aims to provide a clear overview of the rights and responsibility of online publications in the Internet environment and the governance of this environment by public institutions, while encouraging a multi-stakeholder debate with the goal of supporting and strengthening freedom of expression and the professional practice of journalism on the Internet.

Freedom of expression and media freedom under threat

Although there is no specific law on online media in Albania, constitutional principles on freedom of expression and freedom of the press do extend their rights and restrictions to online outlets, while the regulatory environment on Internet governance, both domestic and foreign, influences how these outlets operate and do business.

Newly proposed regulations and amendments on the subject met strong resistance from the journalistic community and rights organisations in Albania and abroad. These moves were also contested by the European Commission and the Council of Europe.

In spite of the government’s attempts to shrink the space for professional journalism, freedom of expression and media are clearly defined in the Albanian constitution as well as in the international treaties and agreements that the country has ratified.

While Albania’s broadcast media and the press are controlled by a handful of powerful families, which have affiliated businesses in regulated markets, online media outlets are more diverse.

Many are start-ups owned by journalists, and allow more diverse viewpoints and reporting angles.

But, even though online media have become one of the main sources of information in Albania, Albanian legislation currently provides no definition of online media. Nor does the audio-visual media law or the e-commerce law.

Access to the internet is vital to free speech

Access to the Internet as a means of communication to exercise freedom of expression and information is guaranteed in Albania in the context of the domestic legal framework.

A survey conducted in 2019 on the use of information technology by families and individuals conducted by the Albanian National Institute of Statistics, INSTAT, showed that 82.2 per cent of all households now have access to the Internet, compared to 80.7 per cent a year earlier, and 66.4 per cent in 2016.

INSTAT found that 68.8 per cent of all individuals aged between 16 and 74 in Albania had used the Internet within three months of the survey being conducted, 87.1 per cent of whom used it daily.

Article 1, of the Law on Electronic Communications in Albania, no. 9918, of 19 May 2008, refers to net neutrality under the principles of the law – but it contains no specific provisions on how to enforce it.

Emerging from the same problematic principles that underpin net neutrality, The Electronic Communications law does not regulate zero rating; it is left to the companies to negotiate or offer such services.

One service previously excluded by data caps from ISPs in Albania has been Facebook Zero. The lack of clarity from the government regarding zero rating is concerning, as it is particularly relevant to journalism and media organisations.

Domain registration is linked to press freedom

Domain name management and administration is central to broader Internet governance, and directly affects press and media freedom within a country.

Domain registration in Albania for the ccTLD .al is regulated in the Electronic Communications law. It stipulates that domain names are registered “to serve the general interest of the public” and “to ensure especially the protection of intellectual property”. Web hosting companies are also mainly regulated by the the Electronic Communications law.

The main institution administering the .al ccTLD and its subdomains is AKEP. This maintains and updates a list of reserved and forbidden names and collects data and documents from the physical persons and legal entities that register.

The BIRN report states that blocking domain names is a key form of censorship imposed around the world, and is often used to prevent access to information and silence dissent.

Social media companies have unfair tax advantage

Online media in Albania operate on the same financial rules and tax regimes as other businesses registered in the country. No specific tax or financial rules, subsidies, or incentives are designed specifically for online media outlets.

Albania’s legal framework does not provide for any form of subsidies for journalism and the media, either for legacy or online media outlets.

Social media companies like Facebook, Google and Twitter, along with other online media not registered in Albania, should have a registered agent in the country and pay a tax rate similar to native online media outlets.

The BIRN report notes that the lack of taxation of their advertising products gives them de facto an unfair advantage to local online media outlets; these are taxed at the rate of 20 per cent.

Online media in Albania have often been the target of verbal abuse by politicians at the highest levels of power. Research conducted by BIRN also indicates that the biggest factors influencing the Albanian media’s editorial line are the political and economic interests of media owners, which in turn place pressure on many journalists to self-censor.

Thus, media outlet ownership transparency is important for the public to identify any political and economic bias that might influence the coverage of a certain topic or issue, as well as recognise conflicts of interest.

However, Albanian legislation does not provide any specific provision for the public disclosure of the ownership of media outlets.

Restrictions on freedom of expression online

Although the Albanian constitution and the European Convention on Human Rights recognise fundamental rights to freedom of expression and freedom of the media, they also provide for proportional restrictions.

Defamation in Albania remains a criminal misdemeanour, punished by fines, while the main legal instrument against hate speech is the provision of several anti-hate crimes and misdemeanours in the criminal code. Hate speech is also addressed, albeit indirectly, in Albania’s anti-discrimination law.

In the context of the infringements, copyright violations are considered one of the biggest problems facing the online media, followed by the lack of quality information and financial difficulties.

Criteria and conditions for copyright protection are listed in the report. Despite the legal protection granted to audio and visual products via copyright, the country’s copyright law (Article 12.1) does not protect news and press information, both offline and online, which are simply informative in nature.

Journalists safeguard the public’s right to know

The growing number and influence of online media have certainly given journalists more space and freedom to express their views and report on different issues in ways that might not always be welcome in traditional media.

Journalists have the right to inform about news of public interest, preserving the essence of information, but they are also obliged to avoid references to personal data when possible. All actions taken by journalists should be shaped by the public interest.

The report lists two sets of special instructions and considerations (Protection of minors and court and crime reporting) for journalists on how to protect personal and sensitive data.

The most recent Code of Ethics for Journalists was drafted in 2018. This was done by the Albanian Media Institute, AMI, with the support of the project Reinforcing Judicial Expertise on Freedom of Expression and the Media in SouthEast Europe, JUFREX – a joint initiative led by the European Union and the Council of Europe.

According to a set of Ethical Guidelines for Online Journalism , online journalism must respect all professional code of ethics and the core values of journalism, irrespective of the forum or format it uses.

No clear rules for content removal

Recognising that content moderation and removal policies are widely debated – and divisive – on the global level, the report provides a non limited list of potential solutions that may contribute to a healthier online environment.

In Albania, no specific law explicitly regulates the filtering and blocking of illegal Internet content. However, the provisions of several laws regulate illegal Internet content. The Electronic Communications law empowers the AKEP to enforce its requirements.

There is no official or published list of what is considered illegal and/or harmful content, or of the competent authorities that can ask the ISPs to remove illegal content. For this reason, the key institutions mandated by law to order the removal of illegal content are listed below, based on the caseload developed by AKEP.

Judicial and law enforcement agencies can request the removal of illegal content based on the relevant articles in the criminal code. One of the most problematic requests from law enforcement agencies, passed on to ISPs through AKEP, was the blocking of the domain of the popular online media Jeta Osh Qef (Joq.al) following the deadly 26 November 2019 earthquake in Albania.

The report also mentions other relevant agencies and bodies dealing with content removal, such as the Audio-visual Media Authority, AMA, and the Commissioner for Personal Data Protection.

Progress in cybersecurity legislation

Albania has made significant progress in recent years in developing the ICT sector and the use of information technology, IT.

Albania ratified the Convention on Cybercrime – known as the Budapest Convention – on 25 April 2002, with Law no. 8888. Its criminal code is mainly in line with this important international instrument, containing several specific articles dedicated to fighting cybercrime.

Although not directly related to cybersecurity, the criminal code also details the consequences of engaging in various anti-social electronic and/or online activities.

Another important law governing cybersecurity is Law no. 2/2017, “On Cybersecurity”; the entity responsible for applying this law is the NAECCES.

The law’s main aim is to achieve a high level of cybersecurity within Albania by defining security measures, rights, and obligations, as well as mutual cooperation between entities operating in the field of cybersecurity.

SEE Digital Rights Network Established

Nineteen organisations from Southeast Europe have joined forces in a newly-established network that aims to advance the protection of digital rights and address the growing challenges posed by the widespread use of advanced technologies in society.

Initiated by Balkan Investigative Reporting Network, BIRN, and SHARE Foundation, the SEE Digital Rights Network is the first network of its kind focused on the digital environment and challenges to digital rights in Southeast Europe.

The network brings together 19 member organisations – from Albania, Bosnia and Herzegovina, Croatia, Greece, Kosovo, Montenegro, North Macedonia and Serbia – dedicated to the protection and promotion of human rights, both online and offline.

Each is committed to advancing their work on issues of digital rights abuses, lack of transparency, expanded use of invasive tech solutions and breaches of privacy.

Since the onset of the COVID-19 pandemic, Central and Southeast Europe has seen a dramatic rise in the rate of digital rights violations, in countries where democratic values are already imperiled.

“This endeavour comes at a moment when we are seeing greater interference by state and commercial actors that contribute to the already shrinking space for debate while the exercise of basic human rights is continuously being limited,” said BIRN regional director Marija Ristic.

“The Internet has strong potential to serve the needs of the people and internet access has proved to be indispensable in times of crisis such as the COVID-19 pandemic. Our societies are becoming more digital, which presents a powerful incentive to increase the capacity of organisations dealing with digital developments and regulations in our region.”

During a first joint meeting, the members of the network agreed that the challenges posed by the fast-evolving tech solutions used by states have led to infringements of basic rights and freedoms, while false and unverified information is flourishing online and shaping the lives of people around the region.

The online sphere has already become a hostile environment for outspoken individuals and especially marginalised groups such as minorities, LGBTIQ+ community, refugees and women.

“Digital technology is profoundly changing our societies as it becomes an important part of all spheres of our lives, so we see the diversity of organisations that joined this network as one of its biggest strengths,” said Danilo Krivokapic, director of the SHARE Foundation.

“We can learn so much from each other’s experience, as we have similar problems with governments using technology to exert control over society, especially in times of crisis such as the COVID-19 pandemic,” he said. “It is also important that we act together when we are trying to restore the balance between our citizens and big companies (Facebook, Google etc) that hold enormous amounts of our personal data and through this exert significant power over us.”

The network’s aim is to build on the skills, knowledge and experience of its members to achieve common goals such as strengthening democracy in the region and protecting individuals in the digital environment.

While cherishing the values of safety, equality and freedom, the work of the SEE Digital Rights Network will be directed at achieving the following goals: to protect digital rights and internet freedoms, enable people to access accurate information, make the internet a safer place, detect and report hate speech and verbal violence online, especially against women and other vulnerable groups, identify online recruitment, which can lead to exploitation, take control of  personal data, work to prevent the implementation of intrusive surveillance systems, hold governments accountable for the use and abuse of technology and improve digital literacy in order to prevent violence and exploitation.

The network will aim to increase the level of understanding of complex and worrying trends and practices, trying to bring them closer to the general public in a language it can understand. By creating a common space for discussion and exchange, organisations and the media will be able to increase the impact of their individual efforts directed towards legislative, political and social changes.

Freemuse Launches Campaign to Tackle Online Violence and Censorship

The #KnowArtisticRights campaign, launched this week, focuses on online violence and censorship while striving to educate people about artistic rights online and the online threats facing artists around the world. Through the campaign, the organisation is providing artists with a step-by-step guide on how to behave in situations where their rights are violated online.

“The largest number of cases of violation of artistic rights and freedoms registered by Freesumse are occurring online,” says Jasmina Lazovic, Program Coordinator Global Monitoring at Freemuse, an independent international organisation based in Denmark, advocating for and defending freedom of artistic expression.

“Online platforms provide perpetrators of online threats the opportunities to choose false names, fake accounts, and can remain faceless. This makes it incredibly difficult to assess or ascertain, with any accuracy, the gravity or the intention behind the threat. In addition, content controls and community guidelines restrict artistic expressions under the guise of indecency wherein expressions from swearing to paintings of nipples are censored.” 

The illustrative document which explains the campaign in detail says: “Digital technology has transformed the way artists find themselves censored or persecuted. Increasingly private corporations, organised hate groups and states use data to harass, censor or persecute artists.”

Freemuse has also launched its first comprehensive Digital Toolkit. The Toolkit is a first of its kind for artists and will serve as a point of departure for individuals to navigate the censorship and harassment presented to them online. 

The Toolkit, produced by Freemuse’s Artist Relations Team in collaboration with digital safety experts, contains practical information and advice for artists on navigating the aforementioned digital challenges on the following topics: securing information and devices online; securing access online; encrypting online communication; handling harassment and life-endangering threats; and engaging with social media community guidelines and content controls.
